Notice of finding no significant impact on the environment and notice of request for release of funds

On or about August 25, 2009, the above named City will submit a Request to the United States Department of Housing and Urban Development (HUD) for the Release of Federal funds to be used for 2009-2010 Community Development Block Grant (CDBG) Projects and 2009-2010 HOME Investment Partnerships (HOME) Projects. All Projects are listed below.
CDBG 09-01 & HOME H09-03 Rehabilitation of Owner Occupied Single Family Residences (Location Unspecified) The City of Warren has allocated $97,000 2009 CDBG funds and $581,979 2009 HOME funds to the City's single family owner occupied residential rehabilitation loan program for low and moderate income households. The maximum loan amount for complete rehabilitation is $26,000. The work performed must include lead-based paint hazard reduction and correction of code violations. A lien for the total cost of the work will be placed on the property. Loan applications are processed on a first come first serve basis. There is currently a 2-year wait for loan application processing.
HOME H09-05 Rehabilitation Resale (Location Unspecified) 2009 HOME funds in the amount of $49,000 have been allocated for this project: to acquire single family homes including but limited to foreclosed properties; to perform substantial rehabilitation on the acquired properties including but not limited to correction of all violations of the property maintenance code and abatement of lead-based paint and asbestos hazards; and to sell the rehabilitated residences to HOME eligible families who don't currently own a home. The property will be acquired from willing sellers. The acquired properties will be zoned for single family residential use and they will be located in existing single family neighborhoods. The proceeds from the sale will be returned to the City's HOME Trust Fund as program income and be used to finance future HOME eligible activities.
HOME H09-01 Habitat New Construction 2009 HOME funds in the amount of $147,000 have been allocated for this project. These funds will used by Macomb Habitat for Humanity (Habitat) to develop and build new single-family homes in the City of Warren. A portion of the construction will be completed by students enrolled in the Van Dyke Schools Building Trades Program or general Habitat volunteers. These homes will be sold at fair market value to Habitat Client Household in accordance with the HOME Program requirements.
The City of Warren has determined that these projects will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional information is contained in the Environmental Review Record (ERR) for each project on file at the location listed below and may be examined or copied, upon request, Monday through Friday between the hours of 8:30 a.m. and 5:00 p.m.

Any individual, group or agency disagreeing with this determination or wishing to comment on the projects may submit written comments for consideration by the City of Warren at the above stated address. All comments received by the close of business on Friday, August 21, 2009 will be considered by the City of Warren prior to authorizing submission of a request for release of funds.
The City of Warren certifies to HUD that James R. Fouts, in his official capacity as Mayor, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the City of Warren to use program funds.
HUD will accept an objection to its Release of Funds and the City of Warren's certification only if it is on one of the following bases:
A. The certification was not executed by the Certifying Officer of the City of Warren; or B. The City of Warren has omitted a step or failed to make a decision of finding required by HUD regulations 24 CFR Part 58; C. The City of Warren has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a Release of Funds by HUD; or D. Another Federal Agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that a project is unsatisfactory from the standpoint of environmental quality.
Objection must be prepared and submitted in accordance with the required procedure (24 CFR Part 58), and shall be addressed as follows:

No objection received after September 9, 2009 will be considered by HUD.
